Terms of Service

Please read these Terms of Service (“Terms”) carefully before using CarScan.ie. By accessing or using our service, you agree to be bound by these Terms. These Terms are governed by the laws of Ireland and comply with the Consumer Rights Act 2022, the EU Consumer Rights Directive (2011/83/EU), and applicable Irish consumer protection legislation.
1. About CarScan.ie
CarScan.ie is operated by CarScan.ie (“we”, “us”, “our”), registered in Ireland, Dublin, Ireland.
We provide informational vehicle history reports compiled from third-party data providers including OneAutoAPI, Cartell, and Brego. Our reports are intended for general informational purposes only. They do not constitute legal advice, financial advice, a guarantee of vehicle condition, or a substitute for an independent physical inspection by a qualified mechanic or motor engineer.
2. Service Description
CarScan.ie aggregates vehicle data from authorised third-party databases and presents it as a report for the vehicle registration number you submit. Our service may include, depending on the tier selected:
- NCT history and expiry dates
- Vehicle technical specifications and registration data
- Mileage history records
- Finance and encumbrance checks
- Stolen vehicle checks
- Write-off and salvage history
- Keeper and colour change history
- Import/export records where available
The scope of data returned depends on the report tier purchased and data available from upstream providers at the time of the query. We cannot guarantee that all data categories will be available for every vehicle.
3. Report Tiers and Pricing
The following tiers are available to consumer users. All prices are inclusive of VAT at the applicable Irish rate.

Dealer accounts are entitled to volume pricing, which is automatically calculated based on monthly usage tiers. Volume pricing details are provided during the dealer onboarding process and on your account dashboard. Dealer pricing supersedes the standard consumer rates above.
4. Pre-Contractual Information (Consumer Rights Act 2022, s.12)
Before you complete a purchase, we provide the following information in accordance with our obligations under the Consumer Rights Act 2022 and Directive 2011/83/EU:
- Description of digital content: A vehicle history report delivered digitally, drawn from third-party databases.
- Total price: Displayed clearly before payment, inclusive of all applicable taxes.
- Functionality: Reports are provided in HTML/PDF format, accessible immediately via your browser and by email.
- Compatibility: Reports are accessible on any modern web browser or PDF reader.
- Identity and contact details of the trader: CarScan.ie, Ireland — support@carscan.ie.
- Complaint handling: Complaints may be submitted to support@carscan.ie and will be acknowledged within 2 business days.
5. Digital Content and Cooling-Off Period
Under the Consumer Rights Act 2022 and EU Consumer Rights Directive 2011/83/EU, consumers normally have a 14-day right of withdrawal (cooling-off period) for distance contracts.
⚠️ Important Notice — Cooling-Off Waiver
Vehicle history reports are digital content not supplied on a tangible medium. In accordance with Article 16(m) of Directive 2011/83/EU and the Consumer Rights Act 2022, the 14-day right of withdrawal does not apply once we begin supplying the digital content, provided you have given your express prior consent to immediate delivery and acknowledged that you will lose your right of withdrawal.
By completing a purchase, you expressly consent to immediate delivery of the digital content and acknowledge that your right of withdrawal is lost once report generation commences.
If a report cannot be generated due to a system error or provider failure, you will receive a full refund. If you believe your report contains a significant error attributable to us (not to the source data), please contact support@carscan.ie within 7 days of purchase.
6. Data Accuracy and Limitation of Liability
CarScan.ie compiles reports from third-party data providers. The accuracy, completeness, and timeliness of the data is dependent on those upstream providers. We do not independently verify the data and cannot guarantee that it is free from error, omission, or delay.
To the fullest extent permitted by Irish law:
- Our total liability to you in connection with any single report purchase is capped at the price you paid for that report.
- We are not liable for any loss arising from your reliance on report data, including but not limited to financial loss, loss of profit, or loss arising from a vehicle purchase decision.
- We are not liable for data errors, omissions, or delays caused by our third-party data providers.
- We are not liable for indirect or consequential losses of any kind.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Irish law, including the Consumer Rights Act 2022.
7. Intellectual Property
Reports generated by CarScan.ie are licensed to you for personal or internal business use only. All intellectual property rights in the CarScan.ie platform, branding, and report format remain with CarScan.ie or its licensors.
You may not reproduce, redistribute, resell, publish, or commercially exploit any report or part thereof without our prior written consent. Reports may not be incorporated into any product or service offered to third parties.
8. Prohibited Use
You must not use CarScan.ie to:
- Scrape, crawl, or programmatically extract data from our website or API without a valid Dealer Agreement permitting such access.
- Resell, sublicense, or commercially distribute reports or report data to third parties.
- Conduct bulk or automated vehicle queries outside a dealer volume agreement.
- Impersonate another person or entity, or provide false information during account registration.
- Attempt to circumvent, disable, or interfere with security features of the platform.
- Use the service for any unlawful purpose, including but not limited to facilitating fraud, vehicle clocking, or identity theft.
- Access the service in a manner that unreasonably burdens our infrastructure.
Violation of these prohibitions may result in immediate account termination, legal action, or referral to law enforcement authorities.
9. Accounts and Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@carscan.ie if you suspect unauthorised access to your account.
Account registration requires accurate information. We reserve the right to suspend or terminate accounts found to contain false or misleading registration details.
10. Account Termination
10.1 Termination by You
You may close your account at any time by contacting support@carscan.ie or via your account settings. Closure does not affect any existing data retention obligations (see our Privacy Policy).
10.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if:
- You breach these Terms in a material way.
- You engage in prohibited use as described in Section 8.
- Your account becomes significantly overdue (dealer accounts).
- We are required to do so by law or court order.
- We reasonably suspect fraudulent activity on your account.
Where practical and lawful, we will give you notice and an opportunity to remedy the breach before termination. On termination, your right to access the service ceases immediately. Unused dealer wallet credit at termination will be refunded subject to verification.
11. Dealer-Specific Terms
The following additional terms apply to registered dealer and business accounts:
11.1 Wallet Top-Ups
Dealer accounts operate on a prepaid wallet credit system. Wallet credits are non-expiring and will remain available for use as long as the account is active. Credits are non-transferable and may not be converted to cash except in the event of account closure (see Section 10.2).
11.2 Volume Pricing
Volume pricing is automatically calculated based on your monthly query volume. Pricing tiers and thresholds are displayed on your account dashboard and may be updated with 30 days’ notice. Volume pricing is applied prospectively and is not retroactively applied to prior purchases.
11.3 Team Access
Dealers may grant team members access to their account. The account holder is responsible for all activity by team members, including their compliance with these Terms and applicable data protection law. Team members must be individual human users; shared credentials are not permitted.
11.4 VAT and Invoicing
VAT invoices are issued automatically for each wallet top-up and are available in your account dashboard. Dealer accounts with a valid Irish VAT number may be entitled to reverse-charge treatment where applicable. It is the dealer’s responsibility to provide accurate VAT information.
12. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted access to CarScan.ie. The service may be temporarily unavailable due to scheduled maintenance, third-party provider outages, or circumstances beyond our control. We will use reasonable endeavours to notify users of planned outages in advance.
13. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Ireland.
Subject to applicable mandatory consumer protection laws, the courts of Ireland shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence, and these Terms do not affect your mandatory rights under the law of your country of residence.
14. Dispute Resolution
In the event of a dispute, we encourage you to contact us first at support@carscan.ie. We will endeavour to resolve complaints within 10 business days.
EU consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Our email address for ODR purposes is support@carscan.ie.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or prominent notice on our website at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarScan.ie with respect to your use of the service and supersede all prior agreements, representations, and understandings of any kind relating to the subject matter hereof.
